05.06.2023 ML,J IA No.1 of 2023 The present interlocutory application is filed by accused Nos.4 and 5 to alter the conditions imposed in the bail granted on 19.04.2023 in Crl.P.No.3604 of 2023.

In Crl.P.No.3604 of 2023, the petitioners/ accused Nos.4 and 5 were directed to surrender before the Court concerned within ten (10) days from the date of order. On such surrender, they were directed to be enlarged on bail on executing a personal bond for Rs.30,000/- with two sureties for the like sum each to the satisfaction of the Court concerned.

The main grievance of the petitioners, who are sister and brother-in-law of A-1, is that they have been falsely implicated in this case, that they are doing tailoring work, that they are unable to secure the sureties for such higher amount of Rs.30,000/-, as they hail from poor family background. Therefore, they are unable to comply with the conditions imposed in the order dated 19.04.2023 in Crl.P.No.3604 of 2023 and hence, the petitioners seek to reduce the surety amount and extend the time for their surrender.

The learned Public Prosecutor opposed this application.

OFFICE NOTE A perusal of the record shows that the petitioners are doing tailoring work and they hail from village background. Considering the financial position of the petitioners, this Court feels that the surety amount appears to be higher side. Therefore, I am inclined to reduce the surety amount to Rs.15,000/- from Rs.30,000/- and rest of the conditions stands good. However, the time is extended for one week from today for surrender of the petitioners as directed by this Court on 19.04.2023 in Crl.P.No.3604 of 2023.

With the above conditions, the interlocutory application is disposed of.
