HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7826 of 2015 ORDER :

This criminal petition is filed by the petitioner/accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.69 of 2015 of Arakuvally Police Station, Visakhapatnam District, registered for the offences punishable under Sections 417 and 420 IPC.

2. Heard the learned counsel for the petitioner and the 1st respondent-State represented by the Public Prosecutor, before admission and before notice to the 2nd respondent and perused the material on record.

3. The above crime is an out come of the report of the 2nd respondent-de facto complainant stating that the petitioner is working as Medical Officer in Primary Health Centre, Lungaparthi of Ananthagiri Mandal, lured the de facto complainant to part with amounts to secure jobs to her and to her persons and now he says as he does not know anything and he did not receive any amount and she is a stranger.

4. Having regard to the above, the matter requires investigation by police. Hence, the facts fall short for this Court to admit the criminal petition, but for to say the petitioner being a public servant entitled to the concession of bail.

5. Accordingly, this criminal petition is disposed of giving liberty to the petitioner to surrender before the learned Magistrate concerned and move for regular bail with notice to the A.P.P. concerned and in such an event and after hearing the Public Prosecutor concerned, the learned Magistrate shall grant bail with necessary conditions on the same day.

The presence of the petitioner is hereby dispensed with at post bail stage and pending investigation. Further remedies are left open to the petitioner after police filing final report and cognizance taken by the learned Magistrate.

6. Miscellaneous petitions pending, if any, shall stand closed.
