This appeal is preferred against award dated 26-9-2003 in O.P.No.321 of 2002 on the file of Motor Accidents Claims Tribunalcum-III Additional District Judge, Karimnagar. Appellant herein is second respondent in the above referred O.P.No.321 of 2002.

The lower Tribunal on a consideration of material on record, granted a sum of Rs.43,000/- as compensation against respondents 1 to 3 jointly and severally and aggrieved by the same, the second respondent i.e., owner of the bus involved in the accident preferred present appeal. When this mater has come up for hearing on 19-12016, 20-1-2016 and 28-1-2016, learned advocate for appellant took time.

Considering the request of advocate for appellant, the matter had been adjourned thrice, again when the matter is listed today, neither the advocate is present nor there is any representation on behalf of appellant's counsel. Considering these aspects, I am of the view that appellant is not interested in prosecuting the case and therefore, appeal is dismissed for non-prosecution.
