HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.793 OF 2017 ORDER:

This Criminal Petition is filed by the petitioner under Section 438 of Cr.P.C. to enlarge him on bail in the event of his arrest in Crime No.26 of 2017 of Munagala Police Station, Suryapet District, registered for the alleged offences punishable under Sections 448, 354 of I.P.C. and Sections 3(1) (r) (s) and 3(1) (w) (1) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, After arguing the matter for some time, Sri Challa Srinivasa Reddy, learned counsel for the petitioner requested this court to permit the petitioner to surrender before the concerned court and to file an application for grant of bail and also direct the concerned Judge to decide the same.

Acceding to the request of the learned counsel for the petitioner, without touching any merits of the case, I deem appropriate to permit the petitioner to surrender before the Special Sessions Judge for Trial of Cases under the Scheduled Castes and Scheduled Tribes Act and on such surrender, the learned Sessions Judge is directed to the decide the said application on the same day itself, if any filed by the petitioner, for grant of bail, after issuing notice to the public prosecutor.

With the above direction, this Criminal Petition is disposed of.
