This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri C BUCHI REDDY, Advocate for the Petitioners and the Additional Public Prosecutor on behalf of the Respondent No.1 and of None appeared for the Respondent No.2. The Court made the following: ORDER

THE HONOURABLE SRI JUSTICE K.SURENDER CRIMTNAL PETITION NO.3598 OF 2023 ORDER:

The Criminal Petition is filed under Section 482 of the Code of Criminal Procedure (for short Cr.P.C.) by the petitioners/ accused Nos.2 to 4 to quash the proceedings against them in FIR No.15l of 2022 on the hle of learned Additional Judicial Magistrate of First Class, Amangal, Ranga Reddy. The offences alleged against the petitioners are under Section 306 read u,ith Section 34 of the Indian Penal Code (for short 'lPC') 2.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor lor the respondent State Perused the material on record 3.

Respondent No.2 is the son of the deceased. He filed complaint stating that the se petitioners were trying to construct house therein and tried to level up the land. When the deceased intervened, there was a quarrel. Subsequently, the father of the deceased u,zrs found dead having consumed pesticide. The on11. allegation leveled against these

petitioners is that they were trying to level the land and picked up quarrel with the deceased. Prima facie, the incident of quarrel may not amount to offence under Section 306 of IPC or abetting suicide.

For the said reasons, this Court deems it appropriate to direct the Investigating Oflicer in FIR No.151 of 2022 on the file of learned Additional Judicial Magistrate of First Class, Amangal, Ranga Reddy, without taking any coercive steps against the petitioners-Accused Nos.2 to 4. The petitioners shall co-operate with the Investigating Officer by furnishing information and documents as sought by him in concluding the investigation. Needless to say, the petitioners shall cooperate with the Investigating Oflicer as and when required for the purpose of investigation.
