Heard Mr. M.A.K. Mukheed for petitioner in WP.No.12280 of 2016, Mr. Mangena Sree Rama Rao for petitioner in WP.No.44079 of 2015 and learned Government Pleader for Land Acquisition. 2.
Petitioners, in these two writ petitions, are substantially complaining against the inaction of the Special Collector (Land Acquisition), Polavaram Project, Rajamahendravaram in concluding the enquiry initiated in File No.B1/ 333/ 2016 dated 21.10.2016 and settling the issue of payment of compensation to persons entitled to in this behalf. To complete the narration, this Court finds it convenient to refer to the order passed by this Court in WP.No.12280 of 2016, which reads thus:
"Notice before admission returnable in three (3) weeks. The learned Addl.
Advocate General takes notice for respondents.
There shall be interim direction to respondents 2 and 3 to consider the petitioners' representations dt. 06.11.2015 and 30.12.2015 and legal notice dt. 23.11.2015 within a period of eight (8) weeks from the date of receipt of a copy of this order."
Thereafter, in compliance with the directions, Special Collector issued notice dated 21.10.2016 to petitioners herein. It is submitted that the enquiry is not completed and on account of continued inaction, the petitioners are not in a position to appreciate where they
stand vis-à-vis entitlement to compensation for acquisition of land in Sy.No.50/ 1 etc.
Having regard to the above circumstances, I am satisfied the writ petitions can be ordered as follows:
1. The Special Collector (Land Acquisition), Polavaram Project, Rajamahendravaram is directed to complete the enquiry and pass final orders in File No.B1/ 333/ 2016 dated 21.10.2016 within eight (8) weeks from the date of receipt of copy of this order.
2. As the subject matter of proposed enquiry relates to rival claims by petitioners, to avoid further delay in the matter, the petitioners are given liberty to file additional material/ explanation, if so advised, within fifteen (15) days from the date of receipt of copy of the order.
As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs. ____________ S. V. BHATT, J December 29, 2016 DSK
