HON'BLE SRI JUSTICE S. RAVI KUMAR SECOND APPEAL No.1498 of 2007 JUDGMENT:

This appeal is preferred challenging judgment and decree dated 20.08.2007 in A.S.No.279 of 2005 on the file of VII Additional District & Sessions Judge (FTC), Vijayawada, Krishna District, whereunder, decree and judgment dated 20.04.2005 in O.S.No.2291 of 1999 on the file of I Additional Junior Civil Judge, Vijayawada is confirmed.

2. This appeal is coming for admission since 2007 and it was once dismissed for non-prosecution in the year 2009 and only on the application to restore appeal filed with delay condonation petition, this court sympathetically considered the applications of appellant and allowed them and restored appeal to its file as per order dated 23.01.2015. In spite of restoration and posting the matter on the request of appellant counsel from 22.01.2016, no interest is evinced to prosecute the appeal.

3. For these reasons, this Second Appeal is dismissed for non-prosecution.

No costs.

Miscellaneous petitions, if any pending, in this Appeal shall stand closed.
