HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 2528 of 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.3268 of 2018 on the file of the IV Additional Junior Civil Judge-cum-XII Additional Metropolitan Magistrate, Kukatpally.

A charge sheet came to be filed against the petitioners for the offences punishable under Sections 448, 323, 504 and 506 IPC. The allegations levelled against the petitioners are that on 16.04.2017 at about 2.00 p.m., both the accused are said to have beat the de facto complainant with hands, abused him in filthy language and also threatened with dire consequences.

From a perusal of the charge sheet, it appears that a prima facie case is made out against the petitioners/ accused Nos.1 and 2. Therefore, I am not inclined to quash the proceedings. 4.
At this stage, learned counsel for the petitioners seeks dispensation of the presence of the petitioners before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioners is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioners in C.C.No.3268 of 2018 on the file of the IV Additional Junior Civil Judge-cum-XII Additional Metropolitan Magistrate, Kukatpally, is hereby dispensed with except on
the dates when their presence is specifically required by the Court. It is made clear that the trial Court shall proceed with the trial. 7.
With the above direction, the Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
