THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No. 8560 OF 2015 O R D E R:

The matter was heard yesterday in depth. On behalf of the Indian Railways, Smt. Ch. Lakshmi Kumari has taken notice while Sri B. Narasimha Sarma, learned counsel has taken notice on behalf of the 1st respondent Indian Railway Catering & Tourism Corporation Limited.

The learned Standing Counsel for the Indian Railways would submit that the Railway Board on 30.03.2015 has taken a decision to continue 12 of its former employees, who were working with the Indian Railway Catering & Tourism Corporation Limited in the service of the said Tourism Corporation only and that they shall not be sent back to the Indian Railways, inasmuch as the 12 individuals have retired from service of the Indian Railways and have also accepted their terminal benefits including monthly pension. In view of the letter of the Railway Board dated 30.03.

2015, the Indian Railway Catering & Tourism Corporation Limited, acting through its Group General Manager (HRD), Hyderabad, has issued necessary consequential proceedings directing all Regional Directors not to relieve the 12 individuals mentioned therein to their parent railway departments. The ten petitioners in this case find their names mentioned amongst those 12 persons. In view of the developments that have taken place, yesterday, the cause in this Writ Petition does not survive for further adjudication and hence, the Writ Petition is dismissed. No costs.
