G.Mallesh v. B.Srikanth Reddy
HON'BLE SRI JUSTICE A. SHANKAR NARAYANA M.A.C.M.A.No.2056 of 2005 JUDGMENT :
As there was no representation for the appellant on 24.11.2015, the matter was directed to be listed under the caption "FOR DISMISSAL". Again, when the matter was listed on 25.11.2015 under the caption "FOR DISMISSAL", at request of learned counsel for the appellant, twice it was directed to be listed after two weeks by removing from the caption "FOR DISMISSAL". Finally, when the matter was listed on 24.06.2016, as there was no representation for the appellant, it was directed to be listed next week under the caption "FOR DISMISSAL".
2. Even today, despite the matter being listed under the caption "FOR DISMISSAL", there is no representation for the appellant. It appears that the appellant is not interested in pursuing the matter.
3. Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. __________________________________ JUSTICE A. SHANKAR NARAYANA 27.06.2016.
