HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.34413 OF 2016 ORDER:
Being aggrieved by the action of the 2nd respondent in withholding the sale deed in respect of agricultural land admeasuring Ac.0-56 cents covered by survey No.232/3 situated at Kothavalasa of Parvatipuram Mandal, Vizianagaram District, vide P.No.160 of 2015 without any reason, present writ petition is filed.
Heard the learned counsel for the petitioner and the learned Asst. Government Pleader for Revenue (AP). With their consent, the writ petition is disposed of at the stage of admission itself. Since the document presented by the petitioner is pending, without expressing any opinion on merits, the writ petition is disposed of directing the 2nd respondent - Sub-Registrar, Parvatipuram, Vizianagaram District, to consider the registration of the document present by the petitioner in P.No.160 of 2015 if the same is in order as per the provisions of the Indian Stamp Act, 1899, and the Registration Act, 1908 and the Rules made thereunder. In case, the 2nd respondent intends to refuse to register the same, he shall pass orders as contemplated under Section 71 of the Registration Act, 1908 recording reasons for such refusal and communicate the same to the petitioners. This exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
