THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37467 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

"....declaring the action of the respondents in not rectifying the mistakes in the revenue records with regard to the land to an extent of Ac.1.40 gts. in Sy.No.88/37, situated at Kumbari village sivar, Koutala Mandal, Adilabad District, Presently Komurambheem Asifabad District inspite of the representation submitted by the petitioner and the legal notice issued by him through his counsel as illegal, arbitrary, abuse of process of law and is a clear case of violation of principles of natural justice and consequently direct the respondents to make the correct entries in the revenue records with regard to the land to an extent of Ac.1.40 gts. in Sy.No.88/37, situated at Kumbari village sivar, Koutala Mandal, Adilabad District, Presently Komurambheem Asifabad District by considering the representation submitted by the petitioner."

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue. With their consent, the writ petition is disposed of at the stage of admission.

Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the 2nd respondent to consider the representation, dated 23.11.2015, submitted by the petitioner by treating the same as one filed under Section 3 (3) of the A.P. Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act').

Learned Assistant Government Pleader for Revenue submits that the petitioner filed representation in the year 2015 and he may be directed to file fresh representation in terms of Section 3 (3) of the Act.

Having regard to the above, the petitioner shall make a fresh representation as per Section 3 (3) of the Act in the prescribed Form before the authority concerned seeking correction of entries in the revenue records, in which event, the same shall be dealt with in accordance with law, after hearing the petitioner and the aggrieved persons, if any, as expeditiously as possible. 6.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
