THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CIVIL REVISION PETITION NO.2332 OF 2016 ORDER:

After arguing for some time Sri T. Poorna Chander Rao, Learned Counsel for the petitioner, would submit that the petitioner would on his own volition vacate the said premises within six months from today. I consider it inappropriate to accede to such a request as both the Courts below have concurrently held that the property is required by the respondents herein for their bonafide requirement.

Ends of justice would be met if the respondents herein are directed not to take any coercive steps to evict the petitioner from the subject premises, on condition that the petitioner furnishes an affidavit of undertaking within ten days from today, voluntarily and unconditionally undertaking to vacate the said premises, and to handover peaceful possession thereof to the respondents herein, within three months from today. In case the petitioner fails to file the affidavit of undertaking within the aforesaid period of ten days or fails to vacate the subject premises within three months from today, it is open to the Court below to proceed and pass further orders in accordance with law.

The Civil Revision Petition is disposed of accordingly. The miscellaneous petitions pending, if any, shall also stand disposed of. No costs.
