T S ANIRUDH REDDY Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend the operation of the Order dated 19-10-2022 passed in I.A. No.61 of 2022 in H.M.O.P.No. 21 of 2022 on the file of the Senior Civil Judge-cum-Assistant Sessions Judge, at Godavarikhani, Pending disposal of CRP No. 3593 of 2023, on the file of the High Court. The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with.(The receipt of this order will be deemed to be the receipt of notice in the case). The Court made the following

ORDER

Heard learned counsel for the petitioner. Perused the record. Learned counsel for the petitioner submits that the respondent has filed a petition for restitution of conjugal rights, though she was already granted a monthly maintenance of Rs.5,000/- in DVC and that she remained in the quarter that was allotted to the petitioner herein. In fact, the petitioner is now working in Mulugu, he was forced to pay a sum of Rs.9,000/- per month towards the quarters rent, which is in occupation of the respondent.

Having satisfied with the reasons explained in the accompanying affidavit and the submissions made by learned counsel for the petitioner' the operation of Order dated 19.10.2022 passed in I.A.No.61 of 2022 in

H.M.O.P.No.2| of 2O22 by the learned Senior Civil Judge, Godavarikhani, is suspended ti[128,12.2023, subject to the condition, the petitioner herein is directed to pay a sum of Rs.15,000/- per month to the respondent towards interim maintenance instead of Rs.20,000/- per month.
