THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.29236 OF 2016 O R D E R :

The case of the petitioner is that the vendors of the petitioner filed an appeal vide Ref:E5/6713/2008 dated 17.11.2014 before the Joint Collector and pending the same, the respondents 4 and 5 are trying to dispossess the petitioner from the subject land. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioner The written instructions issued by the Tahsildar, Kakinada goes to show that possession was taken over by the Government on 29.12.2006 on the ground that the assignees sold the land to the petitioner contrary to the provisions of Section 3(2) of Andhra Pradesh Assigned Lands (Prohibition of Transfer) Act, 1977. Against the same, the vendors of the petitioner filed W.P.No.27284 of 2006 wherein it is observed that "unless and until the petitioners are dispossessed in accordance with the provisions of Section 14 of the Act or in accordance of the provisions of the Andhra Pradesh Assigned Land (Prohibition of Transfer) Act, 1977, the petitioners right to enjoy the land cannot be disturbed".

All the above facts have to be dealt in the appeal filed by the vendors of the petitioner. In view of the same, the Joint Collector is directed to dispose of the appeal filed by the vendors of the petitioner in accordance with law within a

period of four (04) weeks from the date of receipt of copy of this order. Till such time, status-quo obtaining as on today shall be maintained. No costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 30.08.2016 dv
