THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION NO.8280 OF 2018 ORDER:

This Writ Petition is filed by the petitioner herein alleging that they have filed application under Section 40 of the A.P. (Telangana Area) Tenancy and Agricultural Lands Rules, 1950 before the 3rd respondent on 09.10.2017 and the said respondent had not even numbered the said application.

Learned Government Pleader for Revenue appearing for respondents is not able to offer any explanation why the 3rd respondent who is the competent authority under the said statute to consider the application under Section 40 of the Act did not even number the said petition for two years.

Though counter-affidavit has been filed by respondents on the merits of the contentions of the petitioner, I am not inclined to consider the same.

The Writ Petition is, therefore, disposed of and the 3rd respondent is directed to number the petition filed under Section 40 of the said Act by the petitioners, Issue notice to the respondents 4 to 13, consider the contentions of the petitioners as well as the respondents 4 to 13, and pass a reasoned order in accordance with law and communicate it to both parties within two months from the date of receipt of a copy of this order. Any delay in doing so, will be viewed seriously by this Court. 5.

The Writ Petition is disposed of. No costs.
