HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 6045 OF 2017 ORDER:

This Writ Petition was filed challenging the registration of FIR No. 5/2017, under Section 324 IPC and Sectiona 3(1) ® (s), 3 (ii) (va) of Schedule Caste and Schedule Tribe (Prevention of Atrocities) Act, 1989 (for short "the SC & ST (POA) Act"). Learned counsel appearing for petitioner submits that a reading of the complaint does not disclose any offence, so far as the provisions of SC & ST (POA) Act, and the petitioner was unnecessarily implicated in the offence.

Since the matter is under investigation, this Court is not inclined to go into the merits of the case and it is for the investigating officer to make an enquiry impartially and in accordance with law. In the circumstances, this Writ Petition is disposed of directing the respondents to complete the enquiry in accordance with law without harassing the petitioner.
