Learned counsel for the petitioner submits that in similar circumstances, this Court granted interim direction in WPMP No.33952 of 2017 in WP No.27324 of 2017 dated 17.08.2017 and same is not disputed by the learned Assistant Government Pleader for School Education appearing for the respondents. It is the case of the petitioner that there is a ban for filling up of the vacant posts in Aided institutions by the Government through Memo in No.18836/SE/PS/A1/2012, dated 04.01.2017 and G.O.Ms.No.40, School Education (PS) Department, dated 30.06.2017, and the petitioner has submitted proposals to the competent authority for filling up the vacant aided posts in the institution as per the procedure contemplated in G.O.Ms.No.1, Education (PS-2) Department, dated 01.01.1994, but the same is not considered. Hence, the present writ petition is filed.

Learned Assistant Government Pleader for School Education for the respondents submitted that the respondent authorities will consider the said proposals submitted by the petitioner in accordance with Rule 12 of the G.O.Ms.No.1, Education (PS-2) Department, dated 01.01.1994.

Taking into consideration the facts and circumstances of the case and the submissions of the learned Assistant Government Pleader for School Education, without expressing any opinion on the merits, the competent authority is directed to consider the proposals submitted by the petitioner in accordance with Rule 12 of the G.O.Ms.No.1, Education (PS-2) Department, dated 01.01.1994, and take action accordingly. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
