THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9794 of 2019 O R D E R:

The petitioner asserts that respondent Nos.1 to 4 are not taking any action against the illegal construction being undertaken by respondent Nos.5 to 7 in Plot No.40, Survey No.60 of Guttala Begumpet Village, Serilingampally Mandal, Ranga Reddy District, owned by him.

Except making the above said allegation, the petitioner has not made any effort to obtain information from the Municipal Corporation as to whether any permission for construction was granted in favour of respondent Nos.5 to 7.

In those circumstances, this Court is not inclined to entertain the Writ Petition.

Hence, the Writ Petition is closed giving liberty to the petitioner to obtain information by invoking the provisions of the Right to Information Act, 2005, with respect to the particulars of the above said premises, on which, respondent Nos. 5 to 7 are making constructions. On receipt of such information, if the petitioner is satisfied that the constructions made by respondent Nos.5 to 7 are without permission, they are at liberty to invoke the jurisdiction of this Court.

Miscellaneous petitions, if any, pending in this Writ Petition shall also stand closed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:01.05.2019 vhb
