CVNR, J & GSP, J W.A.No.721 of 2016 THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND THE HON'BLE SRI JUSTICE G.SHYAM PRASAD Writ Appeal No.721 of 2016 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ appeal is filed against order, dated 01.04.2016, in WP.No.21475 of 2003.
The necessity of adjudicating the writ appeal on merits is obviated for the reason that to a suggestion made by this Court, respondent No.2 has positively responded and agreed to order reinstatement of the appellant as Conductor only for the purpose of granting him retirement and attendant benefits without back wages.
Accordingly, the order under writ appeal is set aside and the writ appeal is allowed only to the extent of notional reinstatement of the appellant, who has already attained the age of superannuation, for the limited purpose of retirement and attendant benefits without back wages.
