THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON No.31876 OF 2013 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed by the then Government of Andhra Pradesh and its officials in the Prohibition and Excise Department aggrieved by the order dated 22.03.2013 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in so far as it pertained to O.A.No.2062 of 2011.

By order dated 11.11.2013, this Court granted interim suspension of the order under challenge. The first respondent herein, the applicant in the subject O.A., filed I.A.No.1 of 2018 to vacate the aforestated interim order.

Learned Government Pleader for Services-III, State of Telangana, the successor-in-interest of the erstwhile State of Andhra Pradesh, would inform this Court that the seniority of the first respondent-applicant has been fixed in accordance with merit, notwithstanding the suspension granted by this Court, taking into account the law laid down by this Court in other cases.

Sri P.Narasimha, learned counsel for the first respondent-applicant, concedes this position.

In that view of the matter, both the learned counsel state that the cause in this writ petition no longer survives for consideration on merits. The writ petition is accordingly closed.

Interim order dated 11.11.2013 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
