HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 16097 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in retiring the petitioner from service taking a wrong date of birth into consideration, as illegal and arbitrary and consequently declare that the petitioner is entitled to be continued in service on the basis of his correct date of birth i.e., 10.02.1948.

In view of the law laid down by this Court in Konaseema Cooperative Central Bank Limited Vs. N. Seetharama Raju1, the writ petition is not maintainable.

Accordingly, the writ petition is dismissed. Consequently, miscellaneous petitions pending in the writ petition, if any, shall stand closed.
