THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.2276 OF 2010 ORDER:

This petition is filed in the year 2010 seeking quashment of Crime No.503 of 2009 on the file of Women Police Station, CCS, Hyderabad. This Court, on 15.03.2010, admitted the criminal petition and as per Crl.M.P.No.2230 of 2010, interim stay was granted until further orders. 2.

When the matter was called earlier on 17.04.2017, heard the counsel for the petitioner in part. Today, when the matter is called, there is no representation on behalf of the petitioner.

In view of the order of this Court dated 31.07.2017 in Crl.P.No.6493 of 2017, relying upon the latest two Judge Bench expression of the Hon'ble Apex Court dated 27.07.2017 in Crl.A.No.1265 of 2017 (SLP (Crl.) No.2013 of 2017 in Rajesh Sharma & Others Vs. State of U.P. & another), this is also a fit case to refer the matter to the Committee for report to consider any reconciliation. 4.

Having regard to the above and as per the directions of the Hon'ble Apex Court, this Criminal Petition is disposed of, while directing the Investigation Officer to investigate, but not to arrest the petitioners unless report of the Committee on its

constitution is received, however, this order does not prevent the securing for interrogation as part of investigation. 5.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
