HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12769 of 2004 ORDER:

When the matter is taken up for hearing, none appears for petitioners inspite of the fact that the writ petition is being listed under the caption "for dismissal".

A perusal of the record discloses that the petitioners had filed this writ petition seeking to declare the action of respondents in not taking back the employees of 1st respondent to duty including the petitioners, as unconstitutional and consequently direct the respondents to take the petitioners into duty with effect from 01.04.2004 with all consequential benefits. Learned Government Pleader appearing for respondents submits that the petitioners were taken back into service with effect from 01.01.2005 in pursuance to the interlocutory orders passed by this Court on 28.07.2004 and contend that the cause in the writ petition does not survive. This Court, having considered the said submission of the learned Government Pleader, is of the considered view that the cause in the writ petition does not survive.

Accordingly, the writ petition is dismissed as infructuous. It is needless to mention that if the petitioners have still any grievance, they are at liberty to submit a representation to the respondents and the respondents shall consider the same and pass appropriate orders. No order as to costs.
