Sri J.Madhava Reddy, S/o. Late Raji Reddy Petitioner (Accused in Cr.No.752/2017 of P.S.Jawaharnagar) AND The State of Telangana, rep. by Public Prosecutor, High Court Buildings, Hyderabad. Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to enlarge the petitioner/Accused on bail in connection with Crime No. 752 of 2017 dated. 12-09-2017 on the file of Jawaharnagar, Rachakonda Commissionerate, Medchal District. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri K.Ravikanth, Advocate for the Petitioner and of the Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:

" This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioner, who is accused, on bail, in Cr.No.752 of 2017 on the file of Jawaharnagar Police Station, Rachakonda. The offences alleged against the petitioner are under Sections 342, 376 and 506 IPC. 2.

Heard learned counsel for the petitioner/accused and learned Public Prosecutor appearing for the respondent-State. 3.

The case of the prosecution is that the petitioner/accused, taking advantage of helplessness of the de-facto complainant, approached her and threatened her to satisfy his sexual desires. 4.

This Court opines that allegations are grave in nature and do not permit this Court to grant bail. But the counsel for the petitioner submits that the defacto complainant filed memo before the Court below stating that she has compromised the matter with the petitioner. A perusal of the order of the Court below shows that there was such observation made and it was also observed that Aadhar Card of the informant was also filed along with the said memo. 5.

Hence, considering the above circumstances, this Court finds no reason to detain the petitioner/accused any longer in jail. Therefore, the petition is allowed and the petitioner/accused is directed to be enlarged on bail, on condition of his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of the VIII Addl. Sessions Judge Ranga Reddy District at L.B. Nagar.
