Heard Sri Raja Reddy Koneti for petitioner and the learned Assistant Government Pleader (Assignment) for respondents.

2. The petitioner calls in question notice Rc.No.41/ 2017 dated 31.05.2017. The 4th respondent through the notice impugned in this writ petition has informed the petitioner that the possession and occupation of an extent of Ac.10.00 cents in Sy.No.66/ 2B and running a school in the Government land is without permission and the notice refers to a few reminders sent on previous occasions and seeks upon the petitioner to vacate and deliver vacant possession of subject land to the Government. The notice further informs that if the petitioner does not handover possession, the 4th respondent would initiate action in accordance with law.

3. The petitioner apprehends that 4th respondent, having issued a notice and without considering the reply submitted to 3rd respondent, is threatening to dispossess the petitioner from the petition land. The Assistant Government Pleader places on record the written instructions dated 21.06.2017 and reiterates the stand that as notice is issued, the 4th respondent proceeds in accordance with law and takes possession from the petitioner. The petitioner since has given explanation or representation to 3rd respondent, the petitioner is given one week time from today to submit explanation and thereafter, it is open to 4th respondent to proceed in the matter as the circumstances warrant and in accordance with law.

4. The writ petition is disposed of accordingly. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
