HON'BLE SRI JUSTICE S.V. BHATT W.P.No.176 of 2013 ORDER:

Heard learned counsel for petitioner and the Assistant Government Pleader (Revenue).

The petitioner asserts right, title and possession of an extent of Ac.6-36 cents in R.S.No.195 situated at Jangareddigudem Village and Mandal, West Godavari District, on the strength of sale deed, dated 09.09.2009 from one Cheepuru Srinivasa Rao.

According to petitioner, the vendor's father, who was working in Armed Force, was granted Assignment R.O.C.No.351.S.A.(C)92, dated 23.09.1995. Since the assignment was in favour of exserviceman, the alienation by assignee's son in favour of petitioner through sale deed, dated 09.09.2009, is valid and tenable.

The 4th respondent filed counter affidavit denying and disputing each and every one of the circumstances, referred or relied upon by the petitioner.

Having regard to the assertions and reply of 4th respondent, learned counsel for petitioner requests the Court to permit the petitioner to file a petition indicating the

grievance of petitioner before the 3rd respondent within four weeks from today and the 3rd respondent may be directed to conduct enquiry and pass orders in this behalf. As the petitioner desires to work out remedy before the 3rd respondent vis-à-vis an extent of Ac.6-36 cents in R.S.No.195 situated at Jangareddigudem Village and Mandal, West Godavari District, the writ petition is disposed of by granting liberty as prayed for.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
