ORDER
The Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.178 of 2026 before the Madhura Nagar Police Station, Hyderabad, registered for the offences punishable under Sections 69 of the Bharatiya Nyaya Sanhita, 2023.

Brief facts of the case are that on 05.03.2026, the de-facto complainant lodged a report before the Police, wherein she stated that she was in a relationship with the accused for the past eight years. During this period, he promised that he would marry her after that, he started avoiding her. Due to this behavior, she had earlier filed FIR No.717 of 2027 for the offences punishable under Sections 376(2), (n), 471, 420, 354C, 323 IPC, 66E, 67 ITA Act. After that, he was remanded, and after coming out from remand, he again started visiting her house and behaved well with her, assuring her that he would take care of her. On 03.03.2026, she saw a baby shower photograph of the accused with another woman in the Whats-App status of the accused's sister, Manjula. She immediately called the accused and asked him whether he had married someone else. He denied it and told her that it was fake information. As such, she registered a case before the Police. Based on her complaint, the Police registered a case against the petitioner for the aforementioned offences.

Heard Sri G.Santosh Pawan, learned counsel appearing on behalf of the petitioner and Sri M. Ramachandra Reddy,
learned Additional Public Prosecutor appearing on behalf of the respondent.

The learned counsel for the petitioner submitted that on the date of entering into the relationship the petitioner and the de-facto complainant were married persons, and there is no promise to marry her. The de-facto complainant had earlier also registered a case against the petitioner with similar allegations and registering the case on the same allegations is nothing but an abuse of the process of law. He further submitted that the petitioner is ready to co-operate with the investigation and, as such, requested the Court to grant anticipatory bail.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the alleged offences against the petitioner is grievous and heinous in nature, as such he is not entitled for bail. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the de-facto complainant earlier also lodged report before the Police at the similar allegations and case was registered vide FIR No.717 of 2024 and after releasing the bail the petitioner again continued the relationship with the de-facto complainant. In view of the above, this Court deems it fit to grant pre‐arrest bail to the petitioner, subject to compliance with certain conditions. i.
The petitioner/accused shall surrender before the Station House Officer, Madhura Nagar Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.

The petitioner/accused shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case.
iii.
The petitioner/accused shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
