HON'BLE SRI JUSTICE S.V. BHATT W.P.No.33665 OF 2013 ORDER:

The petitioners pray for the following relief: .....the Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not transferring Cr.No.176 of 2013 on the file of the Dabeerpura P.S., Hyderabad to CBCID, Hyderabad in spite of giving representations, dt.26.10.2013 as arbitrary, illegal and issue a consequential direction to the Respondents to transfer the Cr.No.176 of 2013 on the file of the Dabeerpura P.S., Hyderabad to the 6th Respondent and pass such other Order/s as this Hon'ble Court may deem fit and proper in the circumstances of the case". The 4th respondent filed counter affidavit and on the investigation undertaken and the outcome thereof states thus: "It is respectfully submitted that, Sri B.

Vijaya Bhaskar Reddy, SI of Police, P.S. Dabeerpura received the case file and gone through the facts of the case and enquired with the M.O. Offenders Mohd.Abdul Rahaman @ Abdul s/o late Mohd. Ahmed, age 19 yrs, Occ: Student, R/o Near Mira Chilla Yakathpura, Hyderabad to trace the culprits.

It is respectfully submitted that, during the course of investigation all sincere efforts were made by the investigation officers to trace the culprits to detect the case, but in vain.

It is respectfully submitted that, as the case is pending since long time without any clues, basing on that Sri B.Vijay Bhaskar Reddy, SI of Police submitted a proposal to the Asst. Commissioner of Police, Mirchowk Division and accorded permission to refer the case as UN Detected for the Time Being, vide No.406/FR/ACP/MCDVN/2014 dated 11.11.2014. It is respectfully submitted that on 01.04.2015 Sri B.Vijaya Bhaskar Reddy, SI of Police filed the final report in the Hon'ble VIII ACMM, Nampally, Hyderabad

vide Final report No.100/2014, vide S.R.No.1322/2015 as UN Detected."

In view of the above, the learned counsel for petitioner does not press the writ prayer.

The writ petition is, accordingly, dismissed. There shall be no order as to costs.
