HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.9572 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to direct the 2nd respondent not to interfere with the property of the petitioner, without following the due process of law. It is the case of the petitioner that the petitioner is the absolute owner and possessor of plot No.24 admeasuring 300 sq. yards situated in Sy.Nos.63, 66, 69, 70, 72, 73, 76 and 77 of Shantinagar, Kukatpally village and Municipality, Balanagar Mandal, Ranga Reddy District. On 21.03.2016 the 2nd respondent and other officials visited the property of the petitioner and conducted a survey and informed that the property of the petitioner is sought to be acquired for the purpose of parking lot for the adjoining park to be developed. The 2nd respondent without issuing any notice is trying to interfere with the property of the petitioner. Hence, she filed the present writ petition.

Heard and perused the material available on record. The main grievance of the petitioner is that the respondents are trying to interfere with her land, without following the due process of law.

Considering the circumstances of the case and the grievance of the petitioner, this Court is inclined to pass the following order: " The respondents are directed to follow the due process of law, if they intend to acquire the land of the petitioner."

Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
