This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.7, 8 and 9 in the event of their arrest in Crime No.15 of 2023 on the file of Station House Officer, Chegunta Police Station, Medak District, registered for the offences punishable under Sections 436, 452, 427, 147 read with Section 149 of the Indian Penal Code (for short 'IPC').

02. Heard learned counsel for petitioners/Accused Nos.7 to 9 and learned Additional Public Prosecutor for respondent/State. Perused the record.

According to the prosecution version, on 12-01-2023 at about 7:00 P.M., de-facto complainant Smt. Mood Vanitha lodged a complaint stating that at about 12:00 noon, she received a phone call from one Pravin, who informed that her sister Sharada committed suicide by

hanging in the hut and died. Meanwhile, the family members of said Sharada along with some others came to her house, abused them in filthy language, assaulted on houses with stones and other household articles and set them on fire and caused damage to the property.

04. Learned counsel for the petitioners/Accused Nos.7 to 9 submits that neither the complaint nor the FIR would disclose that the specific acts are done by these petitioners. It is further submitted that most of the accused are released on bail.

Learned Additional Public Prosecutor would submit that this is the third bail application filed by these petitioners.

Taking into consideration, the submissions of the learned counsel for the petitioners, I am inclined to allow this criminal petition.

07. Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.7, 8 and 9 shall be enlarged on

bail in the event of their arrest subject to the following conditions:

i) The petitioners/Accused Nos.7 to 9 are directed to surrender before the Judicial First Class Magistrate, Medak District within (15) days from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.10,000/- each (Rupees Ten Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) The petitioners/Accused Nos.7 to 9 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

8. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
