THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA M.A.C.M.A.No.1088 OF 2005 JUDGMENT:

No representation for the appellant.

2. Learned counsel for respondent Nos.1 and 2, who are the driver and owner of the offending vehicle, represents the matter. Though, respondent Nos.3 and 4, New India Assurance Company Limited, represented by its Branch Manager and Divisional Manager, were served with notice, none appears for them.

3. As seen from the proceeding sheet, it is clear that on 22.06.2015, learned counsel for the appellant represented that the sole appellant died and sought time for taking steps to bring the legal representatives of the deceased appellant on record. Though six months' period is elapsed, no steps have been taken.

4. Hence, the instant appeal is dismissed as abated. There shall be no order as to costs.

5. As a sequel thereto, Miscellaneous Applications, if any, pending in this appeal shall stand disposed of. ___________________________ A. SHANKAR NARAYANA, J
