THE HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY AND THE HON'BLE MS. JUSTICE J. UMA DEVI CMA NO. 85 OF 2017 ORDER: (Per Hon'ble Sri Justice C.V. Nagarjuna Reddy) This appeal arises out of order and decree dated 22.12.2016 in D.O.P. No. 197 of 2012 on the file of the Prl. District Judge, Nellore. By order dated 10.3.2017 a Division Bench of this Court had directed appearance of both the parties. A similar direction was also issued by order dated 10.4.2017 fixing today for appearance of the parties.

Today the respondent is personally present. Neither the appellant nor his counsel is present either in the pre-lunch session or in the post-lunch session. The non-compliance of the directions of this Court for personal appearance of the appellant and the repeated absence of his counsel at the hearing indicate that the appellant is not interested in pursuing his cause in the appeal. Hence the appeal is dismissed for non-prosecution.
