Heard the learned counsel for the petitioners and the learned Government Pleader for Land Acquisition.

According to the petitioners, H.No.2-16, KPS admeasuring 1717.28 sq.yards situated at Mamidyala village, Mulugu mandal, Siddipet district was their ancestral property which originally belong to one Mamidala Raghava Rao and thereupon, it was devolved on Kondal Rao, who is the father of petitioners herein. Petitioners allege that since they were away from the village and residing in the city and taking advantage of the same, Venkateshwar Rao S/o Sambasiva Rao got entered his wife's name Shakunthala and his son Ramesh Babu in the Gram Panchayat records without notice to the petitioners.

Petitioners allege that the said house property was acquired by the Government for the purpose of constructing Konda Pochamma Sagar Reservoir under Kaleswaram Project and the respondent authorities are disbursing compensation to Respondents 6 to 8, whereas they are not entitled to receive the said compensation amount. Petitioners also allege that they have made objections before the Respondent authorities, but so far the same are not considered and they have not been paid any compensation. Petitioners apprehend that some of the villagers were paid compensation in terms of awards and there is every likelihood of respondents paying compensation to the unofficial respondents, depriving the rights of the petitioners.

On instructions, the learned Government Pleader submits that the objections filed by the petitioners were considered and payment of compensation to the respondents 7 and 8 was stopped and the land acquisition proceedings are set in motion and after conducting award enquiry, payment will be paid as per the provisions of the Act 30 of 2013.

In view of the above, no relief as sought for by the petitioners can be granted. Therefore, the writ petition is dismissed, leaving it open to the petitioners to work out their remedies as available to them under law. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ____________________ P. NAVEEN RAO, J Date: 4.6.2019 DA
