THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No.8755 OF 2015 ORDER:
Learned Standing counsel for Hyderabad Metropolitan Water Supply and Sewerage Board raised an objection about the maintainability of the writ petition at the first instance in this court in view of the judgment rendered by the Supreme Court in "L.Chandra Kumar v. Union of India and others" and also in view of the view taken by this Court in "M.Sridhar Reddy and others v. Hyderabad Metropolitan Water Supply and Sewerage Board, Hyderabad and others" declaring the Hyderabad Metropolitan Water Supply and Sewerage Board as a local authority and employees of local authority can seek adjudication of their service disputes at the first instance by approaching Andhra Pradesh Administrative Tribunal and thereafter only a judicial review exercise can be carried out wherever it is warranted.
In view of the objection raised about the maintainability of the writ petition at this first instance in this Court without approaching the Andhra Pradesh Administrative Tribunal and allowing that tribunal to decide the service dispute at the first instance, this writ petition is dismissed preserving liberty to the petitioner to seek appropriate relief by approaching the Andhra Pradesh Administrative Tribunal at the first instance. No order as to costs.
