HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT W.P.No.16620 OF 2015 PC: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This Habeas Corpus writ petition is filed by Asma Khatoon, d/o Mohammed Zaheeruddin seeking production of one Pathika Kamaleswari, d/o Pathika Kethano, who, according to her, is her friend.

Learned Government Pleader has filed a counter affidavit of the 3rd respondent, and to the affidavit annexed a statement of Pathika written in her own hand writing. The statement is also signed by SubInspector of Police and by three witnesses. In her statement, she has stated in detail about her strained relations with the petitioner-Asma. It appears from her statement that at one point of time there was a quarrel between Pathika and Asma and she was beaten by Asma. The Police Officer has filed affidavit clearly stating that on 16.06.2015 he called Pathika, and she visited the police station along with her uncle and aunt. He has further stated that on enquiry Pathika told him that she is residing voluntarily with her paternal uncle and aunt since May, 2015 and that her parents are residing at Hyderabad.

Keeping the affidavit of 3rd respondent in view and the statement of Pathika, annexed to the affidavit, we are satisfied that Pathika is not in illegal detention. Asma seems to have filed this petition for settling scores with Pathika. We find no merit in the petition.

The petition is accordingly dismissed.

Consequently, miscellaneous petitions, if any pending, also stand disposed of.
