HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43509 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 3 to 5 in not providing police protection to the life and property of the petitioners on the report/ representation, dated 01.12.2016, in order to secure the compliance of the Judgment, dated 31.12.2014, passed in O.S.No.1324 of 2014 by the VII Senior Civil Judge, City Civil Court, Hyderabad, as illegal and arbitrary, and consequently, direct the respondents 2 to 5 to provide police aid to the life as well as the property of the petitioners. Heard and perused the material available on record. Learned counsel for the petitioner submits that though the 2nd petitioner made a representation, dated 01.12.2016, to secure the compliance of the Judgment stated above, the respondents 2 to 5 are not providing police protection and as such, they seek a direction to the respondents 2 to 5 to give police protection to the petitioners and their property.

Considering the facts and circumstances of the case, the respondent Police are directed to consider the representation, dated 01.12.2016, submitted by the petitioners and provide police protection to the life and property of the petitioners, if the respondent Police are of the view that there is any necessity to provide police protection. Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
