THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.9799 of 2019 ORDER:

The grievance of the petitioner is that the Tahsildar, Thipparthi, Nalgonda District, the fourth respondent, is not effecting mutation in his favour in relation to the land admeasuring Acs.2.20 guntas, inherited by him from his mother, in Survey Nos.32, 34, 36 and 60 of Bheemanapally Village Revenue Shivar, Madgulapally Mandal, Nalgonda District. Perusal of the record however reflects that the petitioner merely made a representation to the Revenue Divisional Officer, Nalgonda, in this regard and acting thereupon, the Revenue Divisional Officer addressed letter dated 22.01.2019 to the fourth respondent requesting him to take necessary action.

It may however be noted that in terms of the procedure prescribed under Section 4 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, read with Rule 18 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989, an application has to be submitted in Form VI-A along with the requisite fee to the recording authority in the event any person seeks mutation.

As the petitioner did not abide by the prescribed procedure, it is not open to him to complain of inaction on the part of the fourth respondent.

The writ petition is accordingly disposed of permitting the petitioner to submit an application in the prescribed format in Form VI-A along with the requisite fee to the fourth respondent seeking mutation in relation to the subject land. In the event such an application is made, the fourth respondent shall consider the same on its own merits and in accordance

with law and due procedure expeditiously and in any event, not later than four weeks from the date of its receipt.
