THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.37401 of 2016 ORDER:

The petitioners seek direction to consider and dispose of representation dated 06-08-2016 made by them before 3rd respondent in the matter of payment of compensation for acquisition of Ac.2-00 cents in Sy.No.253/ in Dachavaram Revenue Village Fields, Kakanur Mandal, West Godavar District.

According to petitioners, the 5th respondent is not entitled to receive compensation and the petitioners are the lawful owners and alone are entitled to compensation.

This matter cannot be considered by this Court under Article 226 of the Constitution of India.

Since the enquiry is still pending with 3rd respondent, it is in the fitness of things the 3rd respondent is directed to register the representation filed by the petitioners claiming compensation, conduct an enquiry, take appropriate decision and communicate the same to parties within four weeks from the date of receipt of a copy of this order.

Till the representation is disposed of, the payment of compensation both to petitioners as well as 5th respondent shall not be undertaken.
