Kondasani Suresh Reddy v. The State Of A.P.
SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2997 OF 2018 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A7, in Crime No.96 of 2018 on the file of Anantapuramu I Town Police Station, Anantapuramu District. The offences alleged are under Sections 420, 406 r/w 34 IPC, 120(B) IPC and Sections 3, 4 and 9(1) of A.P.Gaming Act (Cricket Betting). 2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
The case of the prosecution is that this petitioner was participating in cricket betting. The confession of the accused is read out by the petitioner's counsel, which shows that he has been participating in cricket betting.
4.
Hence, the contention of the petitioner's counsel that the other accused in this case were granted regular bail, cannot be considered to grant anticipatory bail to the petitioner. However, he is at liberty to surrender before the lower court having jurisdiction and obtain regular bail. A direction also is given to the police not to arrest the petitioner, unless Section 41A Cr.P.C. notice is complied with.
5.
In the result, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
