THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.28126 of 2009 ORDER:
This writ petition was filed questioning the action of the excise authorities in reducing the petitioner's quota of rectified spirit/impure spirit from 28,80,000 BLs. to 1,80,000 BLs. for the year 2009-2010. The grievance of the petitioner was that the reduction was effected without assigning any reasons and that the same was in violation of the A.P. Rectified Spirit Rules, 1971. A consequential direction was sought to the excise authorities to allot the balance quota of 27,00,000 BLs. of rectified spirit/impure spirit for the year 2009-2010 by issuing permits to the petitioner.
The petitioner filed W.P.M.P.No.36632 of 2009 in the writ petition seeking an interim direction to the excise authorities to consider its request for allotment of the balance quota for the year 2009-2010 by issuing permits. By order dated 08.06.2011, this Court took note of the fact that the relief sought by way of the W.P.M.P. had become infructuous upon expiry of the excise year 2009-2010 and accordingly dismissed the W.P.M.P. as such.
As the prayer of the petitioner is relatable to the excise year 2009-2010 and no interim orders were granted by this Court, the issue raised in the writ petition has become purely academic and does not warrant consideration on merits at this late stage. The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
