Vallabhaneni Subbarao, v. State Of Aandhra Pradesh
HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.5349 OF 2016 ORDER:
This writ petition is filed questioning the registration granted in favour of the respondents 6 to 12.
It is the contention of the learned counsel for the petitioners that the various norms which are required to be observed for granting provisional registration particularly the requirements mentioned in para No.7 of the guidelines of G.O.Ms.No.7 have to be complied with. Learned counsel extraneously contended and tried to bring to the notice of this Court to various aspects which have not been complied with.
Sri K. Sai Mohan, learned counsel appearing for the respondents 6 to 12 raises objections that it is only a provisional registration which has been granted and at every stage, the petitioners are trying to obstruct the respondents to make use of their land. Infact, he also raises objections with regard to maintainability of the writ petition.
Heard the learned Government Pleader for Revenue. Having considered the rival submissions and inasmuch as the petitioners had not approached the concerned authorities specifically bringing to their notice in what aspects of the matter conditions mentioned in para No.7 of the said G.O.Ms.No.7 having not been complied with, I am not inclined to entertain the writ petition. However, the petitioners may seek appropriate remedy as may be advised including approaching the concerned authorities. Accordingly, the writ petition is disposed of giving liberty to the petitioners to seek appropriate remedy as may be advised including approaching the concerned authorities. No order as to costs.
Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
