THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.8011 of 2018 Order:

It is the case of the petitioner that the land of an extent of Ac.1-11 gts., situated in Survey No.438/1 to 5 of Yekinpur village, Korutla Mandal, Jagtial District is his ancestral property. He states that he filed an application on 14.12.2015 before the third respondent for mutation of his name in the revenue records and when the third respondent did not take any steps, he submitted another representation in Form-6A on 05.10.2017 requesting for mutation of his name. In the meanwhile, it appears that the third parties including the fourth respondent, who is having land adjacent to the land of the petitioner, are making efforts to get the land mutated in their favour. In those circumstances, he submitted a representation on 07.07.2017 stating that the above land belongs to him.

When the fourth respondent tried to interfere with the said land, the petitioner filed O.S.No.87 of 2011 on the file of the Junior Civil Judge, Korutla against the fourth respondent and another for permanent injunction and obtained temporary injunction in IA No.211 of 2017. He also made another representation on 16.10.2017 to the third respondent bringing to his notice about the pendency of the civil proceedings. The present Writ Petition is filed apprehending change of revenue records in the name of the third parties without considering the objections filed by the petitioner in respect of the above land.

As on today, no orders have been passed by the third respondent, but the petitioner apprehends change of entries in the revenue records in favour of third parties without considering the objections filed by the petitioner.

In such circumstances, this Writ Petition is disposed of directing the third respondent to consider the objections filed by the petitioner, in the event of the third respondent entertaining any request for change of entries in the revenue records in respect of the above land. In view of the disposal of the Writ Petition as above, notice to the fourth respondent is dispensed with as the fourth respondent also should be put on notice while considering the request for change of entries in the revenue records.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ A.RAMALI NGESWARA RAO, J Date: 12.03.2018 Nsr
