THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12735 OF 2015 ORDER:
This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioners/A.2 and A.3 seeking grant of anticipatory bail in connection with crime No.210 of 2015 on the file of the Khazipet Police Station, Warangal District, registered for the offences under Sections 420, 417, 506 read with Section 34 IPC.
Heard and perused the records.
The allegation against the petitioners herein is that A.1 and the de facto complainant loved each other and that the elders of A.1, i.e., petitioners 2 and 3/A.2 and A.3, also made promise to the elders of the complainant that they would perform the marriage of A.1 with the complainant. Later, when the complainant and her elders went to the house of the A.1, they refused to perform the marriage and also abused the complainant and her family in filthy language and also threatened with dire consequences.
Admittedly the case is arising out of family disputes between the complainant and the petitioners herein and as such, this Court is inclined to grant anticipatory bail to the petitioners herein. The petitioners/A.2 and A.3 are directed to surrender before the Magistrate concerned on or before 26.12.2015 and on such surrender, they shall be enlarged on bail on the same day on each of them executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum each to the satisfaction of the said Magistrate. Further, the petitioners/A.2 and A.3 are directed to appear before the Station House Officer concerned as and when required.
