HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.10648 OF 2015 ORDER:

Heard learned counsel for the petitioners and Sri Vivek Reddy, counsel for respondents.

The grievance of petitioners against the Award No.C2/892/2013 dated 21.01.2015 is as follows"

"That the petitioners in fact are losing an extent of 44.44 square yards in the widening of road undertaken at the instance of 4th respondent. But in the Award dated 21.01.2015, it is stated as 13.31 square yards as affected area, secondly that compensation is arrived at Rs.18,03,416/- on 13.31 square yards instead of for 44.44 square yards.

The further grievance is that a representation on 20,01.2015 is made to respondent No.3 and the 3rd respondent without considering the objections raised in representation dated 20.01.2015 by reference to revenue deposit, is taking further steps of dispossession and demolition of petitioners from the subject matter of writ petition."

Learned standing counsel Sri Vivek Reddy on instructions submits that the petitioners made a representation but have failed to enclose the documents to accept their right or title either to the extent of 13.31 square yards or the larger extent stated to have been lost in acquisition and no exception can be taken. However, it is submitted that the 3rd respondent is willing to examine both issues viz., the actual extent lost in acquisition and also the claim of petitioners provided the petitioners place before the 3rd respondent the documents on which the petitioners claim right and title to the acquired property.

Having regard to the submission made at bar, the writ petition is disposed of by giving three days time from today to petitioners to file additional representation together with the enclosures of documents of title/plan on which the petitioners claim right and title. The 3rd respondent is directed to examine the claim of petitioners on right/title and the extent of land lost in the acquisition, afford an opportunity to the

petitioners and pass appropriate orders. The said exercise shall be completed within a period of one week from today. Till a final decision is taken in this behalf as directed by this Court, status quo as regards structures and possession shall be maintained for a period of one week.

The writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. ___________ S.V.BHATT, J Date:20.04.2015 Note:
