THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY TRANSFER C.M.P.NO.205 OF 2014 O R D E R:
This Transfer C.M.P. is filed by the petitioner-wife for transfer of O.P.No.2 of 2014 filed by the respondent-husband for divorce, which is pending on the file of the Principal Senior Civil Judge-Cum-Family Court, Warangal to the Family Court, Secunderabad.
The case of the petitioner is that the marriage of the petitioner with the respondent was performed on 06.05.1992 as per Hindu Rites and Customs at Pathanpur, Punjab.
Thereafter, the petitioner joined with the respondent and out of their wedlock, they were blessed with two children. Thereafter, the respondent started harassing the petitioner for bringing additional dowry. On the advice of elders, the petitioner filed a criminal case under Section 498-A I.P.C., and the same ended in acquittal. As the respondent is not maintaining her and the children, she is residing with her parents and filed M.C.No.15 of 2010 on the file of the Family Court, Secunderabad. Thereafter, the respondent filed O.P.No.2 of 2014 on the file of the Family Court, Warangal, for divorce. As there is life threat from the
respondent, she cannot travel all along from Secunderabad to Waranagal.
Though notice is served on the respondent, no counter affidavit is filed and there is no appearance on his behalf. In view of the fact that that the petitioner filed M.C.No.15 of 2010 before the Family Court, Secunderabad as the respondent is not maintaining the petitioner and her children and as there is life threat to the petitioner from the respondent, it would be proper to transfer O.P.No.2 of 2014 from the file of the Principal Senior Civil Judge-cum-Judge, Family Court, Warangal to the Family Court, Secunderabad.
Accordingly, the Transfer C.M.P. is allowed.
Miscellaneous petitioner pending, if any, shall stand closed. No order as to costs.
