The petitioners claim that an extent of 85 sq.yards of land in Ward No.15, Block No.27, Digumarthivari Veedhi, Kakinada was leased in favour of their father in

the year 1966. A thatched house was constructed in an extent of 83.33 sq.yards and Door No.27-9-34 was allotted. The petitioners are in possession and enjoyment of the said property. While so, the respondent Corporation is threatening to dispossess them without following the due process of law.

2. Learned Standing Counsel for the respondent Corporation appearing for respondent Nos.2 and 3 fairly submits that as of now, no such steps have been taken for dispossession of the petitioners and it is only an apprehension of the petitioners, and if necessary, the respondent Corporation will follow the due process of law to evict the petitioners if they are in possession of the subject property.

3. Recording the said submission, the Writ Petition is disposed of granting liberty to the respondent Corporation not to dispossess the petitioners without following the due process of law if the petitioners are in possession of the subject property. There shall be no order as to costs.
