Learned counsel for the appellant would submit that despite efforts made, the appellant is not coming into contact and no instructions are given.

In such an event, it can be viewed that the appellant is not interested in prosecuting the second appeal Accordingly, the second appeal is dismissed for nonprosecution. As a sequel thereto, Miscellaneous Petitions pending, if any, shall stand closed. No order as to costs.
