THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.18034 of 2016 ORDER:
Heard counsel for petitioner and Sri V.S.K.Rama Rao for 5th respondent.
The writ prayer reads as follows:- " ....to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus by directing Respondent Nos. 1-4 herein not to entertain any claim made by the Respondent No. 5 as owner of the House No. 1-70 situated at Cheerlavancha Village of Siricilla Mandal and not to release any compensation amount in favour of the Respondent No.5 and consequently direct the Respondents to issue compensation amount to the petitioner herein...." .
At the time of hearing, counsel for petitioner fairly states that the prayer is broad and virtually amounts to restraining the authorities on one hand from discharging the statutory duty cast on them and secondly prevents the 5th respondent from making a claim or representation as and when a right to whic h the 5th respondent is otherwise entitled to is infringed. I am not proposing to examine the rival claims between the petitioner and the 5th respondent.
Having regard to alternative submission made by learned counsel for petitioner, this Court is satisfied the writ petition can be disposed of by this order.
Respondents 3 and 4 are directed to consider the representation/ objection if any filed by the 5th respondent in the matter of acquisition and payment of c ompensation, afford opportunity to petitioner as well, and pass appropriate orders in accordance with law, as circumstances warrant in this behalf. It is made clear that this court has not examined the merits of the matter and the interim order granted on 02-07-2014 is vacated in view of disposal of the writ petition.
The writ petition is disposed of accordingly. No order as to costs.
