HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.9852 of 2019 ORDER:

The petitioner assails the inaction of the authorities in conducting a survey and fixing the boundaries for his land admeasuring Ac.8-13 guntas in Sy.No.738 and 739 of Palvoncha Village and Mandal, Bhadrachalam main road, Bhadradri Kothagudem District.

It appears that the petitioner made an application in this regard as long back as in the year 2014 and paid the requisite fee. The record also reflects that the Revenue Divisional Officer, Bhadradri Kothagudem District, addressed letter dated 26.9.2018 to the Assistant Director, Survey and Land Records, Bhadradri Kothagudem District, to do the needful in the matter.

However, the learned Assistant Government Pleader for Revenue, State of Telangana, would inform this Court that the authority to be approached at this stage for undertaking a survey would be the Tahsildar and the Mandal Surveyor concerned. He would also point out that as per the procedure now extant, an on-line application would have to be filed along with the requisite fee.

As the petitioner made the payment as long back as in the year 2014 and did not abide by the procedure now being followed, this Court is of the opinion that the revenue authorities cannot be hauled up for any delay on their part at this late stage.

The Writ Petition is accordingly disposed of permitting the petitioner to make a F-line application along with the requisite fee and necessary documents if he wants a survey of the subject land. In the

event such an application is made, the respondent authorities shall take appropriate action thereon as per law and due procedure. Miscellaneous Petitions pending in this Writ Petition shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date: 4th June, 2019.
